EC takes legal action against Hungary over violation of LGBTQ rights

The European Commission has launched infringement procedures against Hungary over its child protection law as well as the insistence by the authorities that a children’s book with LGBTQ content should carry a content warning.

The EC sent Hungary letters of formal notice, the first step of an infringement procedure, saying that the two cases concerned violations of European Union rules and discrimination on the basis of sexual orientation.

In a statement, the commission noted that under Hungary’s new child protection law it is forbidden to carry content aimed at youth below the age of 18 portraying gender identity at variance with gender at birth.

It said the legislation was in breach of the EU’s directive on the free provision of cross-border audiovisual media services and contained “unjustified restrictions that discriminate against people based on their sexual orientation and are moreover disproportionate”.

The EC said Hungary had failed to explain why the exposure of children to LGBTQ content would be detrimental to their well-being or not in line with their best interests.

It added that some of the law’s provisions also violated the bloc’s e-commerce directive, namely the so-called country-of-origin principle, as well as the right to data protection laid down in the EU’s GDPR privacy and security law.

The commission said the Hungarian law was in violation of the EU’s principles of the freedom to provide services and the free movement of goods.

The other infringement procedure concerns the consumer protection authority’s decision to oblige the publisher of a children’s book portraying LGBTQ people to include a content warning to the effect that the book depicts forms of “behaviour deviating from traditional gender roles”. The commission said such an obligation restricted the right to freedom of expression and the right to non-discrimination as enshrined in the EU’s Charter of Fundamental Rights.

The move also violates freedom of expression on the part of authors and publishers, and “discriminates on grounds of sexual orientation in an unjustified way”, the EC said. It added that Hungary had failed to justify the restriction of these fundamental rights or explain why the depiction of LGBTQ content would be detrimental to children’s well-being.

The EC has given the Hungarian authorities two months to respond to its concerns.

  1. What ABSOLUTE NONSENSE !

If there was EVER any doubt that Brussels is the main cesspit of Europe – with European Commissioners and certain M.E.P.s continually ‘stirring up’ the shit – it has now well and truly been dispelled.

The so-called ‘alphabet people’ (in reality SEXUAL DEVIANTS) have NO RIGHTS WHATSOEVER when it comes to the education – IN ANY FORM – of Hungarian children, in spite of what some ‘Brusselites’ might
    believe.

If other E.U. member nations are prepared to have THEIR children ‘indoctrinated’ by such filth then so be it – BUT DO NOT DICTATE TO HUNGARY OR HUNGARIAN PARENTS !

Enough is enough ….the ‘alphabet people’ and their ‘advocates’ / supporters are DISGUSTING to most normal human beings (even if many of the latter do not voice their true feelings for fear of ‘retribution’) and thank goodness the present FIDESZ-led Hungarian Government has had the ‘guts’ to do something about this RIDICULOUS situation.

  2. All this and yet, much loved children’s books by people like Munch have been taken away from children because they use words that some people think are derogatory….like Eskimo. The majority of Inuite do not feel that is a hurtful word in any way. It is a term no longer used but was never meant as an insult. It was actually a beautiful word and the artwork of the young child in a hooded parka typifies what an Eskimo child would have looked like.
So a double standard in ‘protection of children’ is taking place. It is not really about them is it? It is about a small but very vocal group insisting on laws and behaviors that most people do not want their children to even be thinking about instead of just playing, studying, developing skills that will help them be employable and be independent later in life…but mostly they should just be having a time wihtout worry. Don’t know any kids who navel gaze until an adult infringes on their childish thoughts and spoils things for them.

  3. Never a day seems to pass that Hungary is NOT witnessed sitting outside the Rectors office, having to answer for its “flaunting” or writing of its own Rules and Laws that are not those of the campus.
Hungary continues on it’s self destructive path that will see it expelled by the Large Parliamentary Council of Europe.

  4. That is small fry. It is Poland that is hot water over their judicial ‘reforms’. They knew that signing up to the EU meant that EU law has supremacy and if they they think that they can bully the big boys in the EU they are much mistaken. The saying is ‘do not bite the hand that feeds you’. Without EU money Poland would still be a nothing and without the EU it would once again be a nothing.

  5. What is contained in this article, clearly – is the fact, that the “book” is getting thrown at Hungary.
Hungary is in a growing cataclysmic situation in it’s membership of the European Union.
The Finance Minister of the Hungarian Government, on “public” records states that Hungary can survive (12) twelve months without funding from the European Union.
If this is the case – he had better negotiate an additional line of credit with the counterparts in China.
If this is not his “hidden” plan – explain be transparent to the citizens of Hungary – your plan to “self” manage the economy of Hungary.
Hungary through the Political style driven by Prime Minister – Victor Orban and Fidesz, have placed us in this precarious or could be perilous position in our membership of the European Union.
The brand name Hungary – has been Decimated.
What will unfold in coming days and weeks will be ongoing Political ugliness, that will from Hungary’s perspective reverse what is the book – being hurled at them from Brussels.
Hungary must for its Future remain a member of the European Union – at ALL cost.

  6. As usual, “Trepidation” is pontificating to us REAL Hungarians as if she / he / it really knows what she / he / it is writing.

By the way, is she / he / it (“shit” for short) – who writes under the name “Trepidation” – REALLY a bona-fide, voting Hungarian citizen or – like “Norbert’ and “Caritas” – just a demented old fool from another country (possibly Australia) who is a ‘wannabe Hungarian’ (as evidenced by she / he / its frequent usage of ‘us’ and ‘our’ in the lengthy tomes) ?

  7. The EU was supposed to be some sort of unified economic and trading block, in the spirit of ‘together we are stronger’ but right now the EU is forcing their ideologies, rules and regulations down the small countries’ throats. It’s disgusting. It’s about nothing else but the ‘socialist/marxist’ (I can’t even get myself to capitalize that disgusting word) bullies like Germany and their other EU lapdogs wanting to control the other smaller countries — like Poland as in WW 2. No thank you. Not again. History taught us better. I am proud of our Hungarian PM and the Visegrad 4 to have the guts and common sense that other EU countries don’t. Enough of the nonsense. If you think the EU is a good thing — wake up! You are either uninformed or lying to yourself.

  9. Sadly – the EU is another example left wing media and tech. Children are bombarded with lgbq mob tactics – these are the same people who teamed up with the islamaphobia agenda even though any county they rule they are ruled by the Quran and it calls for death of gay people and is still happening.
The EU doesn’t have anywhere near the power the US tech companies have pushing left wing ideology Now we have the Chinese tic-toc. Content not allowed in China but fine for the west. Facebook is more popular in the EU than in the US. These are people who shut out president of the US and spent hundreds of millions to get Biden elected. You may laugh because you hate Trump but If they can do it to US president- no country has a chance. The US military is running ads promoting LGBTQ. Trans people can get there tradition paid for. The government is now using the military to spread illegals across the country with military aircraft. If you have been to China – you know the threat. Imagine no high speed rail and in less than 20 years they have more than than all other countries combined. That’s just one example.
